NearIT privacy policy

I. Introduction

Near S.R.L. dba NearIT, and its affiliates (“​NearIT​”, “​we​”, “​us​”) offers its proprietary mobile application software development kit (“SDK”) and the NearIT online platform (collectively the “​Service​”) to its clients​ ​(“​Clients​”).

This Privacy Policy applies to the Service and the website located at ​https://www.nearit.com/ (the “​Site​”) and sets out the basis on which any Personal Data we collect from you, or that you provide to us, will be handled by us. This Privacy Policy does not apply to any links to third parties’ websites and/or services, such as Client or other third-party websites, applications, or widgets that you may encounter when you use our products and services and/or the Site. We encourage you to carefully familiarize yourself with privacy policies applicable to any websites and/or services operated by third parties. Please be aware that we​ ​are​ ​not​ ​responsible​ ​for​ ​the​ ​privacy​ ​practices​ ​of​ ​any​ ​third​ ​parties.

In this Privacy Policy, the term “​Personal Data​” means information that identifies you or can be used to identify you. We may process Personal Data about the Site visitors, as well as individuals representing Clients.​ ​We​ ​may​ ​also​ ​process​ ​Personal​ ​Data​ ​collected​ ​in​ ​and​ ​through​ ​the​ ​Service.

Your privacy is of the utmost importance to us and we want to be transparent about the Personal Data we collect, why we collect it, how we collect it, and how we share it.   • To​ ​provide​ ​services​ ​to​ ​the​ ​Client;

  • To​ ​send​ ​you​ ​and​ ​the​ ​Client​ ​notifications,​ ​offers,​ ​surveys,​ ​and promotions,​ ​where​ ​you​ ​have​ ​consented​ ​to​ ​be​ ​contacted​ ​for​ ​such purposes;
  • To​ ​send​ ​you​ ​notifications,​ ​offers,​ ​and​ ​promotions​ ​regarding​ ​our Clients’​ ​products​ ​and​ ​services​ ​on​ ​behalf​ ​of​ ​our​ ​Clients;

When you use the Site to request information, subscribe to our newsletter, inquire about the Service, respond to a job opening at NearIT, or otherwise use the Site, we may collect the following information that​ ​you​ ​provide​ ​to​ ​us​ ​and​ ​which​ ​may​ ​constitute​ ​Personal​ ​Data:

Moreover,​ ​if​ ​you​ ​contact​ ​us​ ​or​ ​when​ ​we​ ​contact​ ​you,​ ​a​ ​record​ ​of​ ​this​ ​correspondence​ ​may​ ​be​ ​kept.

(ii) Information​ ​Collected​ ​Automatically

The software used on the Site may automatically collect the following information from you that may constitute​ ​Personal​ ​Data:

  • Your​ ​Internet​ ​Protocol​ ​(“​IP​”)​ ​address;
  • Your location in accordance with the privacy settings of the device used to access the Site or our products​ ​and​ ​services;​ ​and
  • Information about your Site browsing activity such as your browser type, Internet service provider (ISP), referring/exit pages, the files viewed on the Site (e.g., HTML pages, graphics, etc.),​ ​operating​ ​system,​ ​date/time​ ​stamp,​ ​and/or​ ​clickstream​ ​data.

The SDK used in connection with the Service may automatically collect the following information from you​ ​that​ ​may​ ​constitute​ ​Personal​ ​Data:

  • Geolocation;
  • Device​ ​ID​ ​numbers​ ​such​ ​as​ ​Apple​ ​Advertising​ ​ID;
  • Information​ ​about​ ​the​ ​mobile​ ​device​ ​in​ ​which​ ​the​ ​SDK​ ​runs;​ ​and
  • ​Information​ ​about​ ​mobile​ ​device​ ​user​ ​interaction​ ​with​ ​location​ ​technologies​ ​and​ ​notifications.

(iii) Cookies​ ​and​ ​Other​ ​Analytics​ ​Technologies

We may place a “cookie” on the hard drive of the device that you use to access the Site. Cookies are text files that are saved on the hard drive of your device by means of your browser, enabling us to recognize your browser for purposes such as saving your preferences and directing relevant content to you. If applicable, our advertising providers may also transmit cookies to your browser, application, or device on our behalf when you click on ads that appear on the Site. Clicking on a link to a third party website from the Site may also allow that third party website to transmit cookies to you, if any. Most of the currently available browsers give you the option of managing cookies by, for example, disabling them entirely, accepting them individually, and deleting saved cookies from your hard drive. We would like to remind you that if you completely disable cookies on your browser, you might not be able to use some features of the​ ​Site.

We may also use pixel tags on the Site. A pixel tag, also known as a web beacon or clear GIF, is an invisible pixel that is placed on websites. When you access a website where a pixel tag is deployed, the pixel tag may generate a generic notice of the visit and permit the website provider to set or read cookies. Pixel tags are used in combination with cookies to track the activity on a website by a particular browser on​ ​a​ ​particular​ ​device.

(iv) Other​ ​Technologies​ ​Used​ ​on​ ​the​ ​Site​ ​or​ ​in​ ​the​ ​Service

We use a service entitled Intercom, provided by Intercom, Inc., on the Site. Intercom is a user database management service that can also be used as a medium for communications, either through email, or through messages within the Service. Intercom collects email addresses and other types of data as specified in the privacy policy of the service available at https://www.intercom.com/terms-and-policies#privacy​.

We use a service entitled Mailchimp, provided by The Rocket Science Group, LLC on the Site. MailChimp is an email address management and message sending service that collects email addresses as specified​ ​in​ ​their​ ​​privacy​ ​policy​.

We use a service entitled Inspectlet, provided by Inspectlet, Inc., on the Site. Inspectlet is a website use session​ ​recording​ ​and​ ​heat​ ​mapping​ ​service.

Finally, Google Analytics is an element of the Site. By using cookies, Google Analytics collects and stores data such as time of visit, pages visited, time spent on each page of the website, the IP address, and the type of operating system used in the devices used to access the Site. By using a browser plugin provided​ ​by​ ​Google,​ ​you​ ​can​ ​opt​ ​out​ ​of​ ​Google​ ​Analytics.

(v) Information​ ​Received​ ​From​ ​Third​ ​Parties

We may collect the following information from third parties, such as Clients, from publicly available websites and other sources, and from third party data providers that may, in certain circumstances, constitute​ ​Personal​ ​Data:

  • Contact​ ​information;
  • Age;
  • Gender,​ ​and
  • Social​ ​media​ ​profiles.

We may combine and enhance Personal Data about you with information we receive from third parties, and we use the combined information as described in this Privacy Policy. We process the Personal Data obtained from third parties when it is in our legitimate interests to do this and when these interests are not overridden by your privacy and data protection rights. These legitimate interests include our ability to provide our products and services that enable our Clients to increase their brand recognition, increase revenue,​ ​and​ ​manage​ ​their​ ​business​ ​communications.

(iii) Data​ ​Collected​ ​Via​ ​Bluetooth

All major mobile device operating systems enable the users of mobile devices to disable Bluetooth from functioning.

a) iOS

You can disable Bluetooth by going to “Settings” from your Device’s home screen; select “Bluetooth”; and​ ​turn​ ​Bluetooth​ ​off.

b) Android

You can disable Bluetooth by going to the Settings app, then “Wireless and networks,” where you can disable​ ​Bluetooth.

IV. The​ ​Purposes​ ​for​ ​Which​ ​We​ ​Use​ ​The​ ​Personal​ ​Data

  • To​ ​provide​ ​information​ ​to​ ​the​ ​Client​ ​relating​ ​to​ ​the​ ​Service;
  • To send you and the Client notifications, offers, surveys, and promotions, where you have consented​ ​to​ ​be​ ​contacted​ ​for​ ​such​ ​purposes;
  • To send you notifications, offers, and promotions regarding our Clients’ products and services on behalf​ ​of​ ​our​ ​Clients;
  • To provide services and support relating to the Service, as well as our Clients’ products and services;​ ​and
  • To send you other notifications, offers, and promotions, where you have consented to be contacted​ ​for​ ​such​ ​purposes.

Moreover, we may disclose information to third parties in an aggregate format that does not constitute personal​ ​data​ ​and​ ​does​ ​not​ ​allow​ ​the​ ​direct​ ​identification​ ​of​ ​individuals.

The updated list of the third parties to whom we disclose Personal Data may be requested from us at any time.

VI. Data Security

While we use commercially reasonable security measures to prevent unauthorized persons from accessing our files or tampering with the Site, we cannot guarantee that these efforts will always be successful. We do not represent, warrant, or guarantee that the safeguards we have in place will protect the personal data about you. Personal data about you may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to or from us.
